Fred Meyer Jewelers and Littman Jewelers Summer Bridal Celebration Sweepstakes Rules 2016

Official Rules

NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

  1. Eligibility: Fred Meyer Jewelers and Littman Jewelers Summer Bridal Celebration Sweepstakes 2016 (the "Sweepstakes") is open only to U.S. legal residents who are at least eighteen (18) years of age as of June 14, 2016. Employees of Fred Meyer Jewelers and Littman Jewelers, and its parent and affiliate companies as well as the immediate family (mother, father, sister, brother, husband, wife, daughter, son, step-father, step-mother, step-daughter, step-son, step-brother, step-sister, half-brother, half-sister) and/or those living in same household of each are not eligible. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations and is void where prohibited. Sponsor/Administrator reserves the right to verify eligibility qualification of winner. Participation constitutes entrant's full and unconditional agreement to these Official Rules and Sponsor/Administrator's decision, which is final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein.
  2. Sponsor/Administrator: Fred Meyer Jewelers, 3800 SE 22nd Avenue, Portland, OR 97202. The Sweepstakes is in no way sponsored, endorsed or administered by, or associated with, any social media network including without limitation Facebook, Pinterest, Instagram, Google+, YouTube or Twitter ("Social Media Network"). Entrants understand that they are providing their information to Sponsor/Administrator and not to a Social Media Network. Any questions, comments or complaints regarding this Sweepstakes shall be directed to Sponsor/Administrator.
  3. Timing: The Sweepstakes begins on June 14, 2016 at 12:00 a.m. Pacific Daylight Time ("PDT") and ends on August 23, 2016 at 11:59 p.m. PDT (the "Promotion Period"). Administrator's computer is the official time-keeping device for the Sweepstakes.
  4. How to Enter: During the Promotional Period, participants may enter the Sweepstakes by visiting any Fred Meyer Jewelers or Littman Jewelers store, completing the store entry form and submitting it in the labeled box with the instruction: "We're giving away $5,000 in Fred Meyer Jewelers/Littman Jewelers Gift Cards! Enter for your Chance to Win a $500 Fred Meyer Jewelers/Littman Jewelers Gift Card".

    5. Participants may also enter online by visiting the Fred Meyer Jewelers contest page at: www.fredmeyerjewelers.com/Marketing/Contests.aspx or the Littman Jewelers contest page at: www.littmanjewelers.com/Marketing/Contests.aspx. Participants may only enter the contest via in-store entry form or online entry form, one time per two-week period. Multiple entrants are not permitted to share the same email address. Any attempt by any entrant to submit entry forms using multiple/different email addresses, identities, registrations and logins, or any other methods will void that entrant's entry form and that entrant may be disqualified. In the event of a dispute regarding any entry, the authorized account holder of the email address used to register will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Each potential winner may be required to show proof of being the authorized account holder.

  5. Winner Determination: Two potential winners of the Sweepstakes will be selected by random drawing on or about each of the following days: July 18, 2016; August 1, 2016; August 15, 2016; August 29, 2016 and September 6, 2016, from among all eligible in-store and online entries received by the Sponsor/Administrator. The decisions of the Sponsor/Administrator are final and binding on all matters relating to this Sweepstakes. Odds of winning depend on the total number of eligible entries received during the Entry Period.
  6. Winner Notification: The winner(s) will be notified by email ("Notification Letter"). The Notification Letter will include an Affidavit of Eligibility Form to be signed by the Winner and returned by email, mail, fax or hand delivery to Fred Meyer Jewelers within fourteen (14) days of the date appearing at the top of the Notification Letter.

    7. The Affidavit of Eligibility Form must be received by Fred Meyer Jewelers on or before the expiration of such fourteen (14) day period. The failure to return the Affidavit of Eligibility before the expiration of the fourteen (14) day period may result in disqualification effective as of 8:00 AM on the day following the expiration of the Affidavit of Eligibility return date and an alternate winner may be drawn.

    Entrants without a proper address and those who have opted to not be contacted by Fred Meyer Jewelers for any reason will be excluded from the drawing. Notification Letters returned as undeliverable will result in award to alternate.

  7. Winner Requirements: Receiving a prize is contingent upon compliance with these Official Rules. If a potential winner cannot be contacted, or prize is returned as undeliverable, potential winner forfeits the prize. In the event that the potential winners are disqualified for any reason, Sponsor/Administrator may award the prize to another winner, via random drawing of all remaining eligible entries. Acceptance of any prize shall constitute and signify winner's agreement and consent that Sponsor/Administrator may use the winner's name, city, state, likeness, and/or prize information in connection with the Promotion, worldwide, including the Internet, without limitation and without further payment or consideration, except where prohibited by law.
  8. Prizes: A total of ten (10) $500.00 jewelry gift cards (five (5) Fred Meyer Jewelers and five (5) Littman Jewelers) will be distributed over the course of the five (5) week Sweepstakes. Frequency of distribution is as follows:

    For all prizes: Prizes are non-transferable and no substitution will be made unless Sponsor/Administrator, in its sole discretion, determines otherwise. Sponsor/Administrator reserves the right to substitute a prize for one of equal or greater value should it become unavailable for any reason. Winners are responsible for all taxes and fees associated with prize receipt and/or use. Limit: One (1) prize per person.

  9. Release: By receipt of any prize, winner agrees to release and hold harmless Sponsor/Administrator, Social Media Networks and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of its respective parent companies and each such company's officers, directors, employees and agents (collectively, the "Released Parties") from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Sweepstakes or receipt or use or misuse of any prize.
  10. Publicity: Except where prohibited, participation in the Sweepstakes constitutes each winner's consent to Sponsor/Administrator and its agents' use of winner's name, likeness, photograph, voice, opinions, image and/or biographical information and statements for advertising, trade, publicity and promotional purposes without additional compensation, in perpetuity, in any media known and hereafter discovered, worldwide and on the internet and World Wide Web, without notice, review or approval by the Winner and those acting under Sponsor/Administrator's authority.
  11. General Conditions: Sponsor/Administrator reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor/Administrator's reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor/Administrator in its sole discretion. Sponsor/Administrator reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor/Administrator reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor/Administrator's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
  12. Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Sweepstakes or receipt or use or misuse of any prize. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant's sole remedy is another entry in the Sweepstakes, if it is possible. If the Sweepstakes, or any part of it, is discontinued for any reason, Sponsor/Administrator, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor/Administrator reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.
  13. Disputes: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court of Oregon; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor/Administrator in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Oregon without giving effect to any choice of law or conflict of law rules (whether of the State of Oregon or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Oregon.

The winner list will be posted on the Fred Meyer Jewelers and Littman Jewelers' websites after winner confirmations are complete.
